Communications with non-lawyers do NOT attract legal advice privilege
In a landmark decision today, the UK Supreme Court has confirmed in the case of Prudential v HM Revenue & Customs that legal advice privilege does NOT extend to communications between clients and non-lawyers, such as accountants.
This means that any communications between clients and non-lawyers can be forced to be disclosed.
This is a potentially disastrous decision for businesses such as accountants, surveyors, planning consultants, HR consultants and pensions consultants. Their communications with their clients are no longer sacrosanct.
