On 24 August 2016, the Ministry of Justice (MoJ) published a correction slip in relation to The Civil Procedure (Amendment No 3) Rules 2016, which introduce amendments to the Civil Procedure Rules (CPR). These were laid before Parliament on 21 July 2016 and will come into force on 3 October 2016. The principal amendment of the Rules is the replacement of CPR Part 52 (Appeals) with a revised, consolidated version (see Legal update, CPR update: Civil Procedure (Amendment No 3) Rules 2016).
The slip sets out three corrections:
- On page 3 of the statutory instrument at rule 15(a), which relates to the amendment of CPR 88 – Proceedings under the Counter-terrorism and Security Act 2015: “in sub-paragraph (b)…” should read “in sub-paragraph (a)…”
- On page 3 of the statutory instrument at rule 15(b), which again relates to the amendment of CPR 88 – Proceedings under the Counter-terrorism and Security Act 2015: “in sub-paragraph (c)…” should read “in sub-paragraph (b)…”
- On page 14 of the Schedule, the substituted rule 52.24(3), which sets out who may exercise the powers of the Court of Appeal: the fifth sub-paragraph should be renumbered as sub-paragraph (e), where previously it had been recorded as a second sub-paragraph (d).
